1. Acceptance of Terms
By creating an account or using Pruvio, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use Pruvio. These terms constitute a binding agreement between you and Dynamic Trading Ventures LLC d/b/a Pruvio ("Pruvio," "we," "us," or "our").
2. Description of Service
Pruvio is a field service documentation platform that provides photo verification, AI-generated reports, client portals, invoicing, team management, and workflow automation tools for service professionals. We may add, change, or remove features over time.
3. Accounts & User Responsibilities
You must provide accurate information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You may not share an account, create an account on behalf of another person without authorization, or create an account if you are under 13. You are responsible for the accuracy of content you upload and for obtaining any permissions required to photograph, document, or share information about properties, clients, or third parties.
4. Subscription Plans, Billing & Trials
Pruvio offers Free, Pro, Team, Business, and Enterprise plans. Paid plans are billed monthly or annually in advance through Stripe (web) or the Apple App Store / Google Play (mobile). Paid subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
Free trials, if offered, convert to a paid subscription at the end of the trial period unless you cancel before the trial ends. You can cancel at any time from the in-app Settings screen, from your account dashboard on the web, or by managing your subscription directly in the App Store or Google Play. Cancellation takes effect at the end of your current billing period; you will retain access until then.
Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods, downgrades, or unused time. For questions about charges, email [email protected].
5. Payment Processing
Web payments are processed by Stripe. In-app subscription purchases on iOS and Android are processed by Apple and Google, respectively, and are subject to their terms. You are responsible for all applicable taxes.
6. Acceptable Use
You agree not to use Pruvio to: violate any law or regulation; infringe intellectual property or privacy rights; harass, threaten, or harm others; upload content that is illegal, defamatory, or fraudulent; transmit malware or any malicious code; attempt to gain unauthorized access to Pruvio or other users' accounts; reverse engineer, scrape, or resell the Service; or interfere with the normal operation of the Service. We may suspend or terminate accounts that violate this section.
7. Your Content
You retain ownership of all content you upload to Pruvio, including photos, job records, and reports. By using the Service, you grant Pruvio a limited, non-exclusive license to host, store, transmit, display, and process your content solely to provide and improve the Service and to deliver features you request (such as sharing a client portal link).
8. AI-Generated Content
Pruvio's AI features generate content based on your inputs. AI output may contain errors and should be treated as a draft. You are responsible for reviewing AI-generated reports, summaries, and letters before sharing them with clients or relying on them for legal, insurance, or financial purposes.
9. Intellectual Property
Pruvio, including its software, designs, trademarks, and content (excluding user content), is owned by Dynamic Trading Ventures LLC and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms. You may not copy, modify, distribute, sell, or create derivative works of the Service.
10. Termination
You may cancel your account at any time from the in-app Settings screen. We may suspend or terminate your access for violations of these terms, non-payment, or to comply with legal requirements. On deletion of your account, we will remove your personal data and content within 30 days, subject to legal retention obligations described in our Privacy Policy.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or suitable for any particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, Pruvio and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to Pruvio in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify and hold harmless Pruvio from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these terms.
14. Governing Law & Disputes
These terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service shall be resolved exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to their jurisdiction.
15. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated by email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
